Family Mediation


Family mediation can be used to resolve a number of issues arising out of a divorce or separation in a civil partnership.  As an independent third party, a professional mediator will facilitate the negotiation of a number of issues.  If children are involved this could include arrangements such as child and spousal maintenance payments or general arrangements on the best course of action for your childrens future.  Mediaton can also facilitate negotiation on finances in general; including savings, pensions and any debt, regardless if children are involved or not.

Mediation is an attractive alternative to dealing with your separation through the court system.  It can be less stressful than going to court.  In Court the Judge will assess your circumstances and may make a decision that neither party wanted.  In mediation, you stay in control of decisions relating to your children and your finances.  Any proposals that you come to within the mediation can become part of a legally binding order. The process offers a bespoke service to families which is quicker than the court process and often more cost effective.  

In most cases you cannot take your case to court until you find out if mediation can help you first.  If you cannot show that you have considered mediation, the Judge may stop or delay proceedings until you have.

Family mediation can also be beneficial when arrangements that have previously been agreed or subject to a court order may need to be varied to reflect a change in circumstances.

Mediation Information and Assessment Meeting (MIAM)
It is a legal requirement to attend a MIAMs meeting before taking your case to court, though there are certain exemptions.  Also referred to as a first meeting, a mediator is trained to work out whether mediation is right for you and your family.  For further information on MIAM's please see MIAM's.

The ADR Group is a member organisation of the Family Mediation Council (FMC), the umbrella body for professional family mediators.  Our list of Registered Family mediators adhere to the practice and standards as set out by the Family Mediation Council and are deemed qualifed to mediate.
