Rebecca Clark

Civil and Commercial Mediator

Practice Overview

A full time mediator, Rebecca has the unusual advantage of experience as a solicitor advocate in private practice, in-house counsel as Head of Litigation at UKAR (managing the Government interests in Bradford & Bingley Plc, Northern Rock Plc and Mortgage Express), and in business on her own account when she was awarded the coveted Drapers' Award for Best Kidswear Retailer in 2009. This background gives her a unique insight into the needs of the parties when settling disputes and invaluable experience of the process from all three perspectives: party, advisor and mediator.

Professional Background

Rebecca qualified as a solicitor in 1997 at a major city firm in London. After 6 years as a solicitor advocate specialising in commercial dispute resolution, she left the law to concentrate on raising her young family. At the same time, Rebecca set up a retail business from scratch, managing it successfully until its sale in 2010 after winning the coveted Drapers’ Award for Best Kidswear Retailer in 2009.

After a brief return to private practice, Rebecca was appointed Head of Litigation at UKAR (managing the Government interests in Bradford & Bingley Plc, Northern Rock Plc and Mortgage Express), supervising a wide portfolio of insurance disputes, warranty claims, regulatory litigation and claims for fraud and professional negligence against former service providers. In 2013, this role saw Rebecca’s team being awarded the Yorkshire Lawyers Litigation Team of the Year and Rebecca herself the British Legal Award for Legal Counsel of the Year.

Arriving at UKAR a firm believer in mediation, Rebecca was instrumental in UKAR’s change of approach to mediation and saw her attending over 20 mediations as the lead negotiating party and strategically advising on and supervising a considerable number more. Having witnessed first hand the real benefits of mediation, Rebecca became accredited as a mediator by CEDR in 2014 and by the ADR Group in 2015, eventually leaving UKAR in 2015 to practice as a full-time mediator.

As a mediator, Rebecca is able to draw upon her unique set of experiences: not only has she unparalleled experience of participation in mediation as both party and advisor, she has her very unusual experience (for a lawyer) of setting up and successfully running her own retail business. This gives her a very client focussed, yet practical and commercial approach to dispute and conflict resolution.

Rebecca has experience of structurally large and legally complex mediations, for example involving over 1,000 underlying claims with numerous interested parties on each side. Bringing a focused and integrated approach to such complex claims, Rebecca is used to collaborating to devise an appropriate process and format for such mediations.
