Scheme Mediation - Mediate More Effectively
Mediators face different pressures and challenges when conducting mediations with imposed time limitations. Whether you are mediating a three hour County Court dispute or the parties themselves impose tactical time constraints, it is good practice for a mediator to show flexibility and hone the necessary skills.
The DCA (Department for Constitutional Affairs) is engaged in a programme to encourage more courts around the country to adopt mediation. Some have already responded and many more are expected to adopt mediation schemes during 2006/7. The DCA expect the number of mediations administered by the National Mediation Helpline to increase 10-fold over the next 12 months.
Ability to maintain momentum and good communication skills are just two hallmarks of all effective mediators. But how should they be used when time is limited?
There are a number of specific techniques and skills which you need to be aware of and develop which will help you mediate these types of cases more effectively. The objective of this course is to provide delegates with an insight to these techniques and skills together with opportunities to practice them. This course does more than say you have to do the same job only quicker!
This course is very practical. Participants will take part in role-plays, including how to negotiate more effectively, and will be encouraged to take part actively throughout the course. By the end of the programme participants will be able to:
- Adopt a more practical approach to theory and practice of court scheme mediation
- Improve pre-mediation strategy
- Get the mediation off to the right start
- Identify and utilise good time management
- Establish objective criteria to deal with the most awkward party
- Establish objective criteria
- Analyse risk and prioritise objectives
- Consider different closing techniques and their effective deployment
Who Should Attend?
This course has been designed for any mediator participating
in the various County Court schemes that have been set up
around the country and any mediator wanting to undertake time
limited mediations to gain further mediation experience.
Trainer:
David Poole is widely recognised as the of the UK's leading
court scheme mediators. He comes from a commercial background
and is well versed in dealing with prickly customers. He is
a panel member of the ADR Group and Chartered Institute of
Arbitrators and spends much of his time training mediators
and business people.
Continuing Professional Development:
This course carries 6.5 CPD hours awarded by the Law Society of England and Wales and the Bar Council
