ADR Group Civil & Commercial Mediator
Foundation Training Programme
This 40-hour programme provides detailed and comprehensive tuition for any professional seeking to acquire core mediator skills. For those that pass the course (Modules I & II) and wish to practice as a mediator you can apply to join our panel (ADR Net Limited) where you will be put forward for mediation appointments.
Why Mediation?
Mediation is a widely used and practiced method for helping parties to resolve disputes. Although initially promoted as an alternative to litigation, it is now widely recognised as an integral component of the litigation system. Commercial and business sectors acknowledge the benefits of the process and competencies that can be applied to all business practices.
The concept of mediation underpins the whole legal process and can be applied at any stage of a dispute. The Civil Procedure Rules require all parties to a dispute, including lawyers and Judges to actively consider ways to avoid matters being resolved through litigation. Where parties do not consider alternative means then the court has the ability to penalise the parties. This has become very prevalent in recent years and the advice to anyone involved in a dispute must be to consider mediation carefully before they proceed with litigation.
Programme Objectives:
- Understand the role mediation plays in the business and legal community
- Develop advanced facilitation skills to promote communication between parties
- Acquire competencies to distinguish issues from interests and develop commercial solutions
- Enhance your own listening, probing and evaluation skills thereby improving internal communication and working practices
Programme Content:
Our mediator training programme is divided into 3 Modules and can therefore be taken at a pace to suit your development requirements.
Module I: History, Theory and Basic Dispute Recognition - 12 CPD Hours
This is our distance learning CD-ROM. The initial phase gives you an insight into the history and theory of mediation. The CD then takes you through specific tutorials and case studies requiring you to understand the different stages that lead to conflict and dispute and how the issues can best be identified. You will be required to complete 6 exercises, which should be submitted to us before you attend Module II. Allow approximately 12 hours to complete.
Module II: 3-day Core Mediator Competency Programme - 28 CPD Hours
The programme involves tutoring in mediation’s core competencies, planning & organisation, process management, communication, facilitation and creativity in problem solving. Delegate discussion, practical exercises and multiple-choice assessment form part of the programme.
Delegates will also be required to participate in a series of role-play exercises as mediator, observer and party. The course concludes with formal role-play assessment where delegates will be required to demonstrate their skill, knowledge and understanding of the process. External assessors will assist in this phase, which will also be recorded on video to provide maximum feedback opportunity.
The course runs from approximately 8.30am to 8.00pm on all three days.
Successful completion of these two stages will lead to your accreditation as a Civil and Commercial Mediator.
Module III: Leading to ADR Group Panel Mediator Status
For those delegates who wish to perform mediations under the ADR Group banner, on subscribing to our panel (ADR Net Limited) and paying a nominal membership fee you will be required to attend two structured mediations conducted by ADR Group mediators. On each day you will be required to complete an Observation Report Form recording the events that take place during the various phases of the mediation.
